UPON hearing the counsel the Court made the following

 

O R D E R

 

Heard.

By our dated 5th August, 2015, we had granted three months time to learned Principal Judge, City Civil & Sessions Court, Navrangpura, Ahmedabad, Gujarat, to complete the trial and pronounce the judgment in the case pending before him. Learned Amicus Curiae today points out that although the order, mentioned above, permits completion of the trial and pronouncement of the judgment, the Presiding Judge feels handicapped in pronouncing judgment since the said order does not refer to certain previous orders by which such pronouncement had been stayed. Learned Amicus points out thatour order dated 5th August, 2015 ought to be taken to have been passed in modification of all previous orders passed by this

Court to the contrary thereby clearing the decks for

pronouncement of the judgment in the case, trial whereof stands concluded.

 

Mr. Tushar Mehta, learned Additional Solicitor General, appearing for the State of Gujarat, has no objection if a suitable clarification to that effect is granted by us.

 

We accordingly make it clear that learned Principal Judge, City Civil & Sessions Court, Navrangpura, Ahmedabad, Gujarat, shall be free to pronounce the judgment in the case pending before him and our Order dated 5th August, 2015 understood to be in modification of all previous orders that may have restrained the said court from proceedings with the matter. Time for pronouncement of the judgment by learned Principal Judge, City Civil & Sessions Court, Navrangpura, Ahmedabad, Gujarat, is extended by three months from today.

 

Two reports, submitted by SIT, are taken on record.

 

Crl.M.P. No.17500 of 2015 is accordingly allowed and

disposed off.
