A division bench of Supreme Court comprising J Aniruddha Bose and Bela Trivedi decided to hear the matter on the next date and extended the stay on the High Court's order without hearing arguments in opposition to the stay. The Supreme Court continued to stay the bail order, Raut’s release was delayed.

Bombay High Court finally grants him bail. The bench stated that Prima facie Section 13 (unlawful activities) and 38 (membership of terrorist organisation) of the UAPA are applicable and Section 16 (terrorist act), 17 (funds raised for terrorist act) and 18 (conspiracy) are not made out. It also noted that Raut had already spent over five years in prison without trial, further strengthening his case for bail.
However, the bail order was stayed by the Court for a week because NIA sought time to file an appeal in the Supreme Court.

Bombay High Court granted bail to Sudha Bhardwaj (co-accused) while denying the same to, inter alia, Mahesh Raut. The court while held that in the case of Raut, the aspect of legality or otherwise of the extension of the period of detention was of no relevance as they did not avail of the right to be released on default bail before the charge-sheet was filed against them on November 15, 2018. The court effectively said liberty belongs to those who seek it.

NIA Court denied bail to Raut. The court denied bail on the basis that Raut's name was found in a letter retrieved from co-accused Rona Wilson's computer. Raut argued that the existence of the letter is disputed because of forensic reports finding malware infiltration of Wilson's electronic devices.
