The Union Government opposed the bail pleas, stating that the accused were not part of a peaceful protest but a "well-planned conspiracy" to destabilise the government, further claiming that these were not spontaneous riots. Counsel for Fatima questioned the claim that the riots were part of a coordinated "regime change operation", pointing out "not a word of it appears in the chargesheet." The Supreme Court reserved its judgement on the bail pleas.

The Delhi High Court denied bail to Gulfisha Fatima, calling the 2020 riots a "premeditated, well-orchestrated conspiracy", basing their evidence on WhatsApp records and protected witness testimonies. The High Court also dismissed concerns about the delay in trial and said that a "hurried trial" would harm the rights of both the Appellants and the State.

Fatima’s counsel argued that she had already spent over four years in custody and that repeated adjournments had delayed hearings.

The Supreme Court collegium recommended the appointment of HMJ Suresh Kait as the Chief Justice of the High Court of Jammu & Kashmir. Due to the imminent transfer, Gulfisha’s bail appeal sent to a new bench for hearing with connected appeals on August 29, 2024. This is the third time that Gulfisha’s bail would have been argued in the Delhi High Court.

Delhi’s Karkardooma court has directed the Tihar Jail authorities to change the staff who student activist Gulfisha Fatima had accused of harassing her. Gulfisha, had complained to the court that she was being subjected to communal slurs and mental harassment by the prison staff.
