Gadling was granted bail in the Elgar Parishad case after spending almost 8 years in jail without a trial. The Bombay High Court noted that 14 out of the 16 accused in the Elgar Parishad case have already been granted bail. The court invoked Article 14 and granted him bail on grounds of parity and equality. However, he still remains in jail on accounts of the arson incident from 2016 that took place in Gadchiroli district.

After the state’s affidavit was filed, Gadling’s counsel argued that the same was misleading and inaccurate, the Supreme Court re-listed the matter for January 21, 2026 in order to file replies to a pending trial court application in the Arson case.

Gadling's counsel, argued that it had been roughly six weeks since the State was requested to submit the affidavit outlining the reasons for the trial's delay. The court granted the State one week of extension to file the affidavit.

Supreme Court eventually begins the hearing for Gadling’s bail plea in the Gadchiroli arson case. The bench asked a very relevant question to the State, “But why is the trial not going on? …you keep a person in custody without trial for how many years?” The bench adjourned the hearing by mandating the State to file an affidavit explaining, inter alia, the reasons for the delay in trial.

Justice MM Sundresh recused himself from hearing Gadling’s bail plea in the Gadchiroli arson case. This caused delay in deciding on the bail application.
December 2023
In December 2023, Gladling was released on temporary bail from December 25 2023 to January 2, 2024 to travel for a wedding of his family members in Nagpur. Gladling had requested for temporary bail for the wedding on humanitarian grounds.

ED seeks permission to interrogate Gadling, claiming that the accused in the Bhima Koregaon case were members of the banned Communist Party of India (Maoist), and that Gadling was involved in raising funds in collusion with other terrorist organisations to cause disaffection towards India. Court grants permission for interrogation from August 17 to 19.

Gadling is released from jail after the Bombay High Court grants him temporary bail from August 13 to August 21 to attend the funeral rites of his mother on the first anniversary of her death. At the time of her death, in August 2020, Gadling’s request for interim bail was denied. Gadling subsequently returned to jail afterwards.

National Investigation Agency submits draft charges to a special court in Mumbai, claiming that Gadling and others accused in the case were active members of the banned terrorist organization Communist Party of India (Maoist). It also alleged that the accused wanted to establish a “janta sarkar” “via revolution supported by a commitment to protracted armed struggle to undermine and to seize power from the state.”
