MHA asks States/UTs to implement section 479 of BNSS for providing relief to under trial prisoners Section 479(1) of BNSS, 2023 facilitates the release of under trial prisoners who have undergone detention for one-half of the maximum period of imprisonment but does not include those who are held for offence in which the punishment has been specified of death or life imprisonment; earlier the SC had also directed States/UTs that this provision shall/must apply to all under trials in pending cases irrespective of whether the case was registered against them before July 1, 2024
