The Gujarat High Court on Wednesday granted anticipatory bail to Rajkot builder Kamlesh Ramani, who is facing arrest for allegedly drugging and raping a woman in December last year. Rajkot District and Sessions Court had rejected Ramani’s plea for anticipatory bail on January 30. The builder had challenged that order before the HC and the matter came up for hearing before the bench of Justice AJ Desai on Wednesday.
“The court ordered that custodial interrogation was not required since the complainant herself has stated in her affidavit that she was not in proper state of mind when she filed the complaint,” Ramani’s advocate Ashish Dagli said.
After Ramani challenged the sessions court order before the HC, the 20-year-old victim had also filed an affidavit through her advocate. The woman stated in the affidavit that she was not in a proper mental condition as she had got her complaint registered in the aftermath of her attempt to commit suicide by consuming phenyl on the night of December 31. After she attempted suicide opposite a petrol pump owned by Ramani in Sadar area of the city, the woman was rushed to civil hospital. She had filed a complaint on January 1, alleging Ramani spiked her drink with sedatives and raped her at his flat on December 26. The victim was living in Ramani’s flat located on Kalavad Road of Rajkot.
