The Gauhati High Court on February 9 set aside a trial court order discharging Akhil Gogoi in a UAPA case registered against him in 2019 by National Investigation Agency (NIA) in connection with the protests against Citizenship Amendment Bill. The court also allowed NIA to frame charges against the accused in the case.

The National Investigation Agency court on February 23 reopened a case filed under the Unlawful Activities (Prevention) Act against Assam MLA Akhil Gogoi for holding anti-Citizenship Amendment Act protests in December 2019.

The Supreme Court upheld the Gauhati High Court judgement which had set aside the trial court order discharging Gogoi in the case, but it granted bail to Gogoi during the pendency of the trial in the said case.

The Gauhati HC upholds the bail granted to Gogoi in 2020 last year that had held that the materials against Gogoi cannot be prima-facie said to be a "terrorist act" done with the intention of threatening the unity, integrity and sovereignty of India or a terrorist act done with the intention to strike terror in the people.
