CJP has approached the Commissioner of Police of Meera-Bhayandar, Vasai-Virar (MBVV) seeking strict action against the perpetrators behind the brutal killing of a Dalit sanitation worker.
30-year-old Shri Krishna Palaram Tusamad was beaten to death with iron rods in the Bhayandar region located just north of Mumbai municipal limits.
Tusamad was a sanitation worker employed by Chandicharan Sanatan Bind, the owner of Nagmani Jewellers that produces imitation jewellery in Bhayander. Tusamad who belonged to a Scheduled Caste (Valmiki community), was originally from Haryana. He was allegedly beaten to death by Bind with an iron rod on May 7, 2022. As reported by the Free Press Journal (dated May 11, 2022), Tusamad suffered serious head and other injuries and was declared dead by the time he reached the hospital due to excessive bleeding.

A complaint has been filed by his father, Palaram Dhanaram Tusamad which informs the police that relatives of the factory owner, and one Ashish Manas De had also joined in the violence against the defenceless man.
An FIR has been registered under section 34 and section 302 of the Indian Penal Code (IPC) along with Section 3(2)(v) of the Scheduled Castes and Scheduled Tribes (Prevention of Atrocities) Act, 1989 at Navghar police station of Meera Bhayander pursuant to which 11 persons have been arrested so far including the factory owner.
CJP has urged further protection be provided to the victim’s family under the Scheduled Caste and Scheduled Tribes (Prevention of Atrocities) Act, 1989 since the deceased who was the sole earning member of the family is survived by his parents, a wife and four children.
The Act confers certain rights upon the victim and witnesses under Section 15A that includes reimbursement of expenses incurred during court proceedings; social-economic rehabilitation and many more rights and entitlements in accessing justice such as immediate relief in cash or in kind; necessary protection to the victim and the family, etc.
Section 21 of the Act provides the duty of the government to ensure effective implementation of the Act such as provision of adequate facilities to avail justice; provide legal aid; set up committees for formulation or implementation measures; conduct periodic survey of working of the provisions of the act and suggest measures for better implementation; identification of areas where members of SC/ST are likely to be subjected to atrocities, etc.
CJP has urged the authorities to immediately investigate and prosecute, in a time-bound fashion, the acts committed by the accused and ensure that there is a fast-track trial and speedy delivery of justice. CJP has also urged the police to ensure that the deceased victim’s family receives the necessary relief and also requested them to make the progress of the case public.

As part of solidarity with the deceased and the whole community, and other people as well, have decided to gather at RNP Park, Bhayandar this Sunday (May 15, 2022), after marching down the road from Bandarwadi Naka, Bhayandar Station (East) at 5 P.M.
