Mtra Elections: On CJP’s complaint on an MCC violation FIR has been registered against Kajal Hindustani for hate speech

On October 29, an FIR has been registered against the serial hate offender Kajal Shingala, also known as Kajal Hindustani, for delivering anti-Muslim hate speech during an event in Thane. According to the FIR, Hindustani has booked under sections 299, 302 and 353 of the Bharatiya Nyaya Sanhita, 2023, following the complaint submitted by Citizens for Justice and Peace (CJP) to the Chief Electoral Officer, Maharashtra on October 25. In complaint CJP had urged the CEO Maharashtra to take immediate action against the serial hate offender Kajal for delivering her inciting and communal speech, highlighting the violation of Model Code of Conduct (MCC). Following CJP’s complaint, on October 29, Wagle Police Station, Thane City booked the hate offender Hindustani along with the organizer of the event Veer Bahadur Yadav for outraging and wounding religious feelings and statements conducing to public mischief.

Notably, on October 25, Citizens for Justice and Peace (CJP) formally approached Maharashtra’s Chief Electoral Officer, S. Chockalingam, urging swift action and the registration of an FIR against serial hate offender Kajal Shingala. This complaint followed Hindustani’s inflammatory and anti-Muslim speech delivered at the Rananragini Sammelan on Lal Bahadur Shastri Marg in Thane West on October 19, 2024, organized by the right-wing extremist group Sakal Hindu Samaj.

According to the FIR, an event was organized by Veer Bahadur Yadav, Mehandipur Balaji Mitra Parivar (Thane) in which Mrs. Kajal Hindustani aka Kajal Shingala was invited as the keynote speaker for the said event. Around 400 to 500 people were present for the event. At the same time, Kajal Hindusthani during her speech addressed the Muslims and gave many examples of how a Muslim youth brutally murdered a Hindu girl in Delhi. He also called Muslim youths “Jihadists”. Also referring to the Waqf Board as “Land Jihad” they are illegally grabbing land and trying to turn India into an Islamic State.

Further, Kajal Hindustani has hurt the sentiments of the Muslim community by making divisive statements suggesting that Hindus should exclusively purchase goods from Hindu traders. She urged Hindus to display banners of “Varah” God in front of their shops, effectively promoting a boycott of Muslim vendors.

Additionally, Hindustani made derogatory accusations against Muslims, claiming they were involved in illegal conversions. She further targeted Christians by referring to them pejoratively as “Fatherwala,” as per FIR.

It is important to mention that, while accusing Muslim and Christian citizens of forceful religious conversion, Kajal Hindustani employed derogatory slurs such as “Chadar Wala” and “Father Wala,” and deliberately propagated the false narratives of “Land Jihad” and “Love Jihad.” These conspiracy theories aim to create divisions and incite fear within communities. Hindustani also targeted Bollywood actors for their interfaith marriages, according to CJP’s complaint.

Notably, in its complaint before CEO Maharashtra, CJP asserted that the speech delivered by serial hate offender Kajal Hindustani constitutes a blatant violation of the Model Code of Conduct (MCC). This rhetoric not only undermines the integrity of the electoral process but also falls under the provisions of the Bharatiya Nyaya Sanhita, 2023. Furthermore, Hindustani’s statements were in direct violation of Section 123(2) and (3) of the Representation of the People Act, which prohibits the promotion of hatred or enmity on the grounds of religion, caste, or community in relation to elections. This section explicitly bars any candidate or their agents from appealing to religious or communal sentiments to garner votes. The term “Jihadi” used for Indian Muslims are not only divisive and derogatory but also an insidious attempt to exploit religious sentiments for electoral benefit.

In its complaint, CJP also emphasised that the Model Code of Conduct (MCC) was in effect following the election schedule announcement and highlighted how the hate speech delivered by Kajal Hindustani violated several key MCC guidelines. Specifically, Part I, General Conduct, Clause 1 prohibited activities that exacerbated divisions or fostered mutual hatred. Hindustani’s use of terms like “Jihadi” aimed to instill fear and mobilize support, directly contradicting the MCC’s goal of promoting fairness in the election process. Additionally, Clause 3 forbade appeals to communal feelings for votes, yet Hindustani’s rhetoric invoked communal sentiments, risking alienation between different religious groups

The FIR, which cites violations of the Bharatiya Nyaya Sanhita, 2023, highlights the need for accountability in maintaining communal harmony. CJP’s unwavering commitment to combating hate speech not only seeks to hold hate offenders accountable but also emphasizes the crucial importance of adhering to the Model Code of Conduct during electoral processes. CJP aims to protect vulnerable communities and foster a more inclusive society, thereby reinforcing the rule of law and ensuring that divisive narratives have no place in our democracy. This decisive action marks a significant step in the ongoing fight against hate.
