Life continues to be cruel to this 13-year-old survivor of rape, as to prevent her from being influenced while trial is going on, the high court, on Monday , was compelled to deny her father the minor girl’s custody . The court also gave considerable importance to the fact that the main accused in the case is the girl’s uncle, and he lives in the same house as the girl’s father. The HC held that she has to stay in the protection home until her deposition is completed.
However, keeping in mind the ordeal the girl is going through on being separated from her family , the single-judge bench of Justice J B Pardiwala has given permission to the girl’s father and grandfather to meet her next Sunday under conditions set by the court.The HC has given strict instructions that they should be have properly and not try to influence her about the trial, or else it would entail criminal action.
In this case from Amreli district, the girl’s parents had separated when she was a twoyear old child. Her father raised her with the help of his grandparents. She was sent to a `vikas gruh’ in a nearby village for studies, as the family could not afford her education, otherwise. In 2014, the `gruh mata’ of the institution discovered that she was raped by her uncle.
