The Supreme Court on Wednesday told the Jammu and Kashmir government that its appeal against the conflicting orders of high court benches in Jammu and Srinagar one banning cow slaughter and the other scrapping the provision banning slaughter would be heard on Monday .
The decision was taken by the Chief Justice H L Dattu-led SC bench, after senior advocate Amarendra Saran mentioned the appeal.
The HC’s Jammu bench on September 8 directed the police to enforce the Ranbir Penal Code (RPC) provision banning sale of beef in the state. A week later, the HC’s Srinagar bench issued notice to the state on a PIL which sought striking down of the RPC provision banning slaughter of bovine animals. The state then moved a special leave petition in the SC on Tuesday saying the HC’s two conflicting orders “have grave ramifications for the law and order situation in J&K as the orders are being misused and interpreted in a manner so as to disturb peace in the state“.“SC should ensure that there is uniformity and consistency in judicial pronouncements and there is no scope to exploit present situation by disrupting communal harmony , amity and peace,“ the state said.
